Public Hearings top

The applicant seeks a revocable consent to construct and operate an enclosed sidewalk cafe with 10 tables and 31 seats on the 65th Street side of the restaurant.

Ms. Coliango expressed her concerns regarding the empty lot next door to the restaurant, which the applicant owns. She stated that it is not maintained and there are mice and mosquitos.

The Chairman inquired if anyone else from the public sought recognition. Hearing none, a motion was made by Bart Allegretti to close the public hearing. Seconded by Don Clark. Unanimously adopted.

The applicant seeks an amendment of variance permitting a department store (use group 10A), not permitted as of right in a M3-1 district, and increasing the degree of non-conforming use on the zoning lot.

The Chairman inquired if anyone from the public sought recognition. Hearing none, a motion was made by Man Wai Lau to close the public hearing. Seconded by Laurie Windsor. Unanimously adopted

Public Portion top

Mary Placanica, representing Assemblyman William Colton, thanked the community for their support in fighting the MTA service cuts to the B64 route. She advised that as of January 6th, 2013, the B64 bus route will be completely restored.

She further advised that Assemblyman Colton and Mark Treyger are requesting that Governor Cuomo issue an executive order requiring the NYS Department of Motor Vehicles to waive and refund registration and transfer fees retroactively, for hurricane victims.

Jane Carey, representing Councilman Greenfield, advised that free immigration and legal services will be available on the second Wednesday of the month at the District Office, located at 4424 16th Avenue. Anyone interested in the services can call 718- 853-2704 for an appointment.

Liam McCabe, representing Congressman Grimm, advised that the Congressman visited Coney Island Hospital to see the damage caused by Hurricane Sandy and is committed to the rebuilding efforts.

He further advised that the Congressman is working diligently to ensure that $60 billion Superstorm Sandy Supplemental Appropriations Bill is passed by the House.

Lynda Thompson advised that the Wounded Warriors Soldier Ride would no longer be coming to 18th Avenue. She stated that one of the reasons was that there were many complaints from the residents regarding the event, so they decided to move it.

The Chairman inquired if anyone else from the public sought recognition. Hearing none, a motion was made by Antonio Troia to close the public portion of the meeting. Seconded by Matt Bromme. Unanimously adopted.

Minutes top

A motion was made by Mafalda DiMango to accept the minutes of the December 12, 2012 meeting. Seconded by Louis Crispiano. Unanimously adopted.

Assemblyman Peter Abbate top

The Assemblyman advised that due to reapportionment his district offices have been relocated to 6604 17th Avenue and 6605 Fort Hamilton Parkway, the phone numbers remain the same.

He further discussed some of the programs that the Governor announced in his State of the State speech. He additionally discussed the gun control measures that were being enacted in the legislature.

Councilman Gentile top

Councilman Gentile addressed the recent events of people being pushed from the subway station platforms onto the train tracks. He stated that he has suggested, in the absence of a long term solution that motormen slow down their trains when entering stations to avoid hitting someone who might be on the tracks.

The Councilman further advised that he would be organizing a clean-up campaign to address litter and graffiti in the Spring. In addition, his staff, in conjunction with the Department of Sanitation, will be making school presentations to teach the children about proper litter disposal.

In closing, the Councilman advised that he has brought the 2013 Alternate Side Parking Suspension calendar for those interested.

Man Wai Lau, Chairman of the Planning and Zoning Committee, reported that the committee has met and a site visit was conducted at the subject location. He stated that to the best of their knowledge the applicant has complied with the required regulations for an enclosed sidewalk cafe. The committee has recommended approval of the application as presented.

A motion was made by Don Clark to approve the revocable consent to construct and operate an enclosed sidewalk cafe with 10 tables and 31 seats on the 65th Street side of 6422 Bay Parkway. Seconded by Ross Brady.

The Chairman addressed the issue brought before the Board during the public hearing regarding the empty lot neighboring the restaurant. He stated that this lot is not part of this application and was subject to a previous variance but has not been developed. However, we will be referring the issues brought forward to the appropriate agencies for inspection.

Don Clark spoke in support of the restaurant. He stated that they were a community oriented business and is a welcome addition to this corner.

A motion was made by Don Clark to approve the application as presented. Seconded by Msgr. Cassato. Unanimously adopted.

Mr. Lau advised that the applicant is seeking an amendment to an existing variance to construct a department store at the above site.

The shopping center is occupied by 6 buildings on the zoning lot consisting of Toys R Us, Babies R Us, Kohl's. Modell's, Pizza D'Amore, Pearle Vision, Best Buy, TD Bank and HSBC Bank. The uses of these buildings contain existing conforming and permitted non-conforming Use Group 10A department store use.

The existing building, located on the north east corner of the shopping center, was formerly occupied by Strauss Discount Auto Store, automotive sales and service establishment, including certain repairs, Use Group 16 and 7. The proposal calls for this one-story building to be demolished (7,502 s.f.) and replaced with a 2-story building, Use Group 10A. (34,626 s.f.)

The property is zoned a M3-1 district which, allows a maximum floor area of 2.0. The existing floor area is .45, and with the construction of the proposed new building it would increase .03 to .48. The height of the proposed new building at 40 feet is less than the height of 60 feet permitted in the M3-1.

A motion was made by Laurie Windsor to approve the application as presented. Seconded by Paul DiSpirito. Unanimously adopted.

Chairman's Report top

Mr. Guarinello advised that the next meeting of Community Board 11 will be held on Wednesday, February 13, 2013.

The Chairman suggested that if people haven't already received their flu shots they should consider doing so. Media outlets are reporting flu or flu-like symptoms widespread in New York. Downstate at Bay Ridge offers free flu shots and are open from 10 AM -9PM, 7 days-a-week.

District Manager's Report top

Marnee Elias-Pavia reported that the Department of Sanitation began their annual curbside Christmas tree collection on January 2nd, and will run through this Saturday, January 12th. Residents should remove all tree stands, tinsel, lights, and ornaments from trees before they are put out at curbside for removal. Trees must not be placed into plastic bags. Clean, non-bagged Christmas trees that are left on the curb between Wednesday, January 2nd and Saturday, January 12th will be collected, chipped, and made into compost. The compost will be processed and subsequently spread upon parks, ball fields, and community gardens throughout the city.

She further advised that the Parks Department has advised that they are working on an emergency contract for the Shore Parkway promenade to pave the walkway and replace the railings that were damaged during the storm. They have advised that this work will not begin until sometime in February. A meeting is in the process of being scheduled to further discuss the project.

The District Manager announced that the Department of Homeless Services will conduct the Homeless Outreach Population Estimate on Monday, January 28, 2013. They are seeking volunteers to help survey streets, parks, subways and other public spaces to estimate the number of people living unsheltered in our city. New Business top

Man Wai Lau spoke regarding door-to-door utility salespeople. He stated that these people do not represent Con Ed and the public should not give out personal information.

The Chairman urged residents to be very careful when dealing with door-to-door salespeople and never give identifying information.

The Chairman inquired if there was any other new business. Hearing none, a motion was made by Antonio Troia to adjourn. Seconded by Bart Allegretti. Unanimously adopted.
